The Right to Mock, Ridicule and Criticize Religion - Exploring the Limits of Free Speech in a Democratic and Just Society

This paper seeks to explore the limits of one of the most fundamental human rights—the right to freedom of expression, especially in relation to hate speech and blasphemy. This issue has been brought to the forefront of public debate by several unfortunate events in Europe, and in particular by the heinous murder of the Charlie Hebdo journalists in January 2015, after the satirical magazine published cartoons of the Prophet Muhammad. This paper examines and critically reevaluates the set of criteria developed in the jurisprudence of the ECtHR, which seek to achieve balance between freedom of expression and freedom of religion—two sometimes conflicting rights.
