Establishing ICC jurisdiction over ISIS - theoretical and practical challenges
According to the UN Reports, The Islamic State in Iraq and the Levant has caused considerable loss of life, bodily injury, and destruction of property and infrastructure in Iraq and Syria since its emergence in 2013. In 2015, Prosecutor Bensouda has found so far no ICC jurisdiction exists regarding ISIS because: “I have come to the conclusion that the jurisdictional basis for opening a preliminary examination into this situation is too narrow at this stage.” The presentation explores what are available options for international justice, primarily ICC, to get engaged with ISIS crimes.
