Regulation of the Right to the Healthy Environment
Everyday life cannot be regulated as a whole by legal norms, despite the fact that the development of technologies and science demand from the enactors of the legal norms to regulate the relationships in production and services according to the principle that fundamental human rights to life and health must be protected. Human right to a healthy environment in the Republic of Croatia has the status of constitutional right. "Everybody has a duty, in the area of its competences and activities to care specially about the protection of the people, nature and human environment" (Art. 69. of the Constitution). In this complicated part of human relationships numerous subjects, the enactors of legal norms, can be found: State (namely, Croatian Sabor), Government of the Republic of Croatia, ministries, bodies and organizations, bodies of local and regional self-government (in communes, towns and counties), as the numerous employers and their organizations (in the protection at work in its broadest sense), trade-unions and other organizations as well as many other subjects. The subjects are numerous, but more numerous are the legal regulations they enact, so the question can be made whether it is the matter of too much regulating (or something else) in the legal regulations on protection of environment and health. In this article the scientific preconditions (objective and subjective) in some precise competences, planning of regulations and group-work (multidisciplinary approach), hard procedure and knowledge (common and special) are suggested, considering the validity in of the enacted regulation space and time. Finally, in spite of lingual, logical and political (teleological) perfection of regulations, they will remain only the good projects without realization, if not accepted and realized in the conditions of strategically good organization as well as efficient communication of certain subjects (physical and legal persons, bodies and organizations) in demanding co-life and healthy environment.
