Translation in International Arbitration
This chapter attempts to show how translation plays a significant role in the harmonization of international arbitration. Although English has become the lingua franca of international arbitraton, translation will always be in high demand to ensure the participation of as many legal cultures as possible. Focusing on problems of translation in the production of multilingual instruments of international arbitration, the author shows how terminological considerations and the formulation of mandatory and non-mandatory provisions can affect the interpretation and application of the various language versions of such instruments and be decisive in ensuring cultural neutrality and legal certainty in the resolution of international disputes.
