The Implementation of the Decisions of the Constitutional Court of the Republic of Croatia
There are five general rules for the implementation of decisions of the Croatian Constitutional Court. First, decisions of the Court are binding and every natural and legal person has the obligation to obey them. Second, all the bodies of the central government and of local and regional self-government have the obligation to implement the decisions of the Court, within their constitutional and legal jurisdiction. Third, the Government of the Republic of Croatia ensures the implementation of the decisions of the Court through the bodies of central administration. Fourth, the Court may itself determine which body is authorized to implement its decision. Fifth, the Court may determine how its decision shall be implemented. In addition to these general rules, the Constitutional Act on the Constitutional Court of the Republic of Croatia provides for some special legal instruments relating to the implementation of the Court’ s decisions.
