Turning Civil Procedure upside down: From Judges' Law to Users' Law
The paper discusses the trends in the development of the civil procedural systems in Europe, arguing that the 'modem' civil procedure of the nineteenth and twentieth centuries still carries a number of features that are inappropriate for contemporary societies. Insofar, the author juxtaposes the dominant features of the 'old' civil procedure to the new, emerging approach that emphasizes the needs of society - the "users' law".
