The Common Heritage of Mankind and the Protection of the Underwater Cultural Heritage
In this paper the author intends to show that the notion of the "cultural heritage of mankind", which clearly also relates to the underwater cultural heritage, forms part of the concept of the common heritage of mankind. He, thus, explains the relevance and scope of the common heritage of mankind principle in relation to the protection of the underwater cultural heritage in international law.// In the first part, the origins of the “ common heritage of mankind” in international law are explored, notably in the law of the sea and in the law of outer space. Then, the author discusses the common heritage of mankind principle as applied in the field of cultural heritage protection in general, finally arriving at the specific issues that this principle poses with regard to the underwater cultural heritage.
