Relations Between the Anti – Discrimination Act, the Constitution and Other Acts Prohibiting Discrimination
In this chapter authors are analyzing interrelations between various legislation in the Republic of Croatia which holds provisions on equal treatment. Special attention is given to constitutional prohibition of discrimination where case law of the Croatian Constitutional court is being scrutinized. Albeit the Constitutional court is deriving inspiration from the case law of the European court of Human Rights (ECtHR), the practice of this court is somewhat inconsistent, unclear and based on different principles than those put forward by the case law of ECtHR. Since the normative activities of the legislator culminated in the summer of 2008 when the Anti discrimination Act was passes, authors are questioning how to coordinate and apply the provisions of numerous acts whose application is affected by the Anti discrimination Act taking effect. The answers to this questions are given in the final part of this chapter.
