Indeterminacy vs. Precision in the Language of International Arbitration

The paper discusses instances of lexical indeterminacy (ambiguity and vagueness) in the English original and the Croatian translation of the Arbitration Agreement between the Government of the Republic of Croatia and the Government of the Republic of Slovenia, starting from the main deictic categories: space, time, and person, and focusing on a crucial issue in the border dispute between the two states and its different interpretations. In addition, it analyzes determiners, modifiers, modal auxiliaries and passive constructions in terms of vagueness vs. precision. The impact of English as the language of the Arbitration Agreement on the Croatian version of the document is also discussed in terms of differences in the conventions of legal writing.
