Finality of European Integration? – The Lisbon Treaty and the German Federal Constitutional Court
In its Lisbon judgment of 2009, the German Federal Constitutional Court elaborated a philosophy of European Integration that subjects further integrative steps subject to national ratification and further constitutional scrutiny. The paper is exploring the key positions of the Federal Constitutional Court and discussing its consequences for the future evolution of the European Union. Possible influence of the BVerfG to other national legal systems is also discussed, particularly in light of potential enlargement to Southeast Europe. In this context, the paper examines relevance of the German understanding of the European Union as a Staatenverbund, i.e. as an association of sovereign States, for constitutional debate in candidate countries.
