The Roman foundations of the modern arbitrator are discernible in the question of its concept. In most cases arbitrators are nowadays selected from among persons who are experts in the relevant field of law or in the disputed subject matter. Exclusion of the public, confidentiality, effectiveness, adaptability, exclusion of appeal and reliance on arbitration agreement are fundamental features of both modern and Roman mechanisms of private dispute resolution.
