Codes of Ethics and Codes of Conduct for Public and Civil Servants in Anglo-Saxons and Ex- Yugoslavian Countries – Can a Common Pattern be found?

This paper deals with the codes of ethics and codes of conduct for public and civil servants in two historically, economically and culturally different clusters of countries, the Anglo-Saxons and Ex-Yugoslavian countries. The paper offers a theoretical explanation of the distinctions between codes of ethics and codes of conduct, as well as it explains the forms in which the codes can be written. The subjects (objective of the code, general principles, conflicts of interests, termination of office, disclosure of assets, acceptance of gifts or other favours, confidential information, political activity, the belonging of the code to the provisions governing the employment conditions, enforcement mechanisms) elaborated by the Model codes of conduct established by the UN and Council of Europe, are used as a pattern according to which the code of every one of the countries belonging to these clusters is examined and explained. This comparison makes it possible to find some similarities between codes in these two clusters of countries, but it also points out the significant differences between them. A special attention is placed on Croatian Code of Ethics for Civil Servants and real consequences of its implementation on normative and organizational level in civil service. Finally, it is important to say that the codes are just one instrument used to develop ethical behaviour of the servants, and every state has to create a code that will best adopt to its cultural, administrative and social conditions.
