Cooperation between the European Commission and the Competition Authorities

The aim of this article is to comprehend and examine the cooperation and the division of powers between the national competition authorities and the European Commission after the Regulation 1/2003. In 2009, the Commission published the Report on the functioning of the Regulation 1/2003 where it assessed how the modernization of EU antitrust enforcement during the first years has worked. The main focus of the article is on the interrelation and interference of work between the Commission and national competition agencies. The author will attempt to indicate the problems resulting therefrom and offer possible solutions. The main issues and specific boundaries in the division of competences between national agencies and the Commission will be considered. The solutions and given answers may serve as a useful guide for the Croatian Competition Agency in the application of the Regulation 1/2003 when Croatia becomes a full member of the EU.
