Some Remarks on the Conclusion of Contracts inter absentes in Roman Law
The aim of the article is to analyze the problem of formation of contracts concluded inter absentes in Roman law and especially when the contract was concluded and its effects. Main challenge in this effort represents the lack of sources and the absence of any general principle. The solution on how the jurists answered possible questions in this sphere is sought through the analysis of texts dealing with similar circumstances. They mainly come from the materials on mandatum and societas dealing with the unilateral dissolution of contracts. Additionally, the texts on the position of letter in correspondence are examined as the letters and messengers were the principal means for the conclusion of contracts inter absentes, which point to the reception of letter in corrective role to the cognizance of its content as determinant for the moment of contract conclusion.
