The Legalization of Illegal Buildings: Current Situation in Croatia

The most recent legislation in the field of building in Croatia includes the new law on illegal buildings, which is the basis for the legalization of all illegally build properties. Illegally built buildings are those that were constructed without planning and building permit and cannot be entered in land registers. To regulate this process, the Act on Proceeding with Illegally Built Buildings was put in the practice 2011, updated 2012. There is a digital air photo of all Croatian properties built by 21 June 2011, so if a building is on that air photo, it can be legalized. The final deadline for which owners of illegally built buildings can apply to have them legalized will be 30 June 2013. Illegally built buildings are at risk of being removed by owner or government with the owner bearing all costs. The paper presents the process of legalization i.e. preparation of technical documentation according to the new law. The process ends with the registration of the building in land registers. The paper discusses the interrelated economic, social and environmental challenges associated with this phenomenon. The paper gives an overview of emerging policy response. This new law on illegal buildings has caused public and professional reactions, both pro and contra. In the concluding section, evaluations and comments of the implementation results of new law have been made.
