The controversy about condicere in D. 12, 1, 4, 1
The fragment D. 12, 1, 4, 1 (Ulpianus 34 ad Sab.) is controversial regarding its treatment of pignus, as it has originally most likely dealt with fiducia, and the possible use of condictio in its context. Analysis of the concept and the use of condictio in classical law shows that the only one that could have been used there was condictio furtiva. This fragment does not provide circumstances which could warrant its use, which reinforces the interpolation theories.
