The urgent preliminary ruling procedure – PPU in the area of FSJ
Preliminary ruling procedure is the main tool in ensuring the uniformity in application of EU Law in the Member States. This paper considers the new urgent preliminary ruling procedure (so called PPU – from French ''procédure préliminaire d’urgence''). It is the ''new'' sub-type of the preliminary ruling procedure that is applied only in the area of freedom, security and justice. It came into force on 1 March 2008. The PPU is governed by Article 23a of the Statute and Article 105 of the Rules of Procedure of the Court of Justice. The author explores the reasons for the introduction of the PPU, compares it with the regular preliminary ruling procedure and points to the most important differences between the two procedures. The author will also analyze some new aspects of its aplication, after 5 years of its introduction. For this purpose, author will analyze in detail ''Report on the use of the urgent preliminary ruling procedure by the Court of Justice'' and any relevant case law in order to extract relevant conclusions about its aplication.
