Trade Codes and commercial law in Yugoslavia in the interwar period (1918-1941)
The interwar Yugoslavia was characterised by variety in the organisation of the judiciary and law taken from the previous legal systems. Existence of six legal areas means that each legal area had its own legal sources, so regarding commercial law we can differentiate: Trade codes, customary trade laws and civil laws. Six Trade codes which were effective in Yugoslavia can be classified into two categories: 1) The French type which embraced Serbian and Montenegrin Trade codes modelled on the Code de commerce, and 2) The German type covering Austrian Trade Code, which is basically General German Trade Code of 1861, as well as the Croatian-Hungarian Code of 1875 following the Austrian model and the Bosnian- Herzegovinian Code of 1883 based on the Croatian-Hungarian Code. Unification and codification of commercial law started very early. The Unification board decided to follow the draft Trade code for Serbian kingdom of 1912, considering also regulations of the German Trade Code (1897), and the Austrian draft of Trade Code (1920). Result of this process was Trade Code of 1937, which was voted in the Assembly and then sanctioned by the King, but never came into force.
