Pure Sociology, Behaviour of Law and the Crisis of Social Control. Towards a Blackian Explanation of Croatia’s Legal Troubles

The paradigm of pure sociology developed within the sociology of law and its propositions are primarily substantiated with examples and data from the legal practice. Donald Black, the founder of pure sociology, predicts in his book "The Behaviour of Law" that the law varies inversely with other social control and that the quantity of law increases as the quantity of other social control decreases and vice versa. The proposition should be applicable to all social situations regardless of their scope - from an encounter in the street to social life across the world. Since the appearance of pure sociology in 1970s there have been several attempts to test its main propositions. Some findings within the studies which aimed at testing Black's theory didn't confirm the main proposition but rather claim the opposite - the "other" social control is positively correlated with the mobilisation of law. Pure sociological propositions on the behaviour of social control in general and of law in particular haven't been used and tested in Croatia. We believe that Black's theory might explain the relationship between Croatian legal trends and the transformation of social control in general after Croatian societal "transition" since the beginning of the 1990s. Our aim is to investigate the capacity of Black's theory to explain the ebb and flow in the quantity and style of the social control within Croatian society and institutions and prepare specific pure sociological explanations which can be empirically verified.
