Violations of Personality Rights on the Internet: International Jurisdiction and Applicable Law
Doctoral dissertation “Violations of the Personality Rights on the Internet ‒ International Jurisdiction and Applicable Law” is primarily focused on research of the private international law issues arising in connection with violations of personality rights on the internet. For the purpose of this private international law analysis, substantive law aspects of the personality rights in the selected legal systems, namely German, Italian, Croatian, English and US are dealt with at the outset. In its central part, the dissertation examines the issue of establishing international jurisdiction in proceedings instituted as a result of the personality rights violations on the internet, with the emphasis on the Brussels I bis Regulation and its interpretation by the Court of Justice of the European Union. Likewise, the thesis is dedicated to in-depth research of the issues arising with regards to determining the applicable law to the violation of the personality rights on the internet. The results of the mentioned analysis create basis for de lege ferenda proposals.
