Arbitration in Croatia
The national report on Croatia reviews the law and practice of arbitration in Croatia. It provides first a short survey of the development of arbitration law since 1990, scope of arbitration and related legislation, current literature and case-law. It then addresses the relationship between arbitral tribunal and the state courts, including the cases in which the state court performs functions of supervision and assistance, the rules on competence of state courts regarding the intervention in arbitration proceedings, rules on proceedings before the state court and finally rules on arbitral award and available remedies. The report than deals with the private international law (PIL) in arbitration proceedings. It closes with an analysis of the institution and arbitration rules in Croatia. The report addresses the matters of jurisdiction and venue, outlines the procedure applicable to arbitration proceeding, explains rules on the burden and standard of proof, production and presentation of evidence, funding and costs and concurrent proceedings.
